Safety-sensitive roles and drug testing: transport, offshore and construction

For some safety-sensitive roles, a legal basis to test for alcohol or drugs does exist. This applies mainly to professions under the Aviation Act, the Railway Act, the Local Rail Act and the Shipping Act. For most other roles, including in transport or construction, that exception does not simply apply.

Which roles fall under a legal regulation?

These are roles where someone is responsible for the safety of a large group, such as pilots and train drivers. There, a breathalyser test can be mandatory, for example. Outside these legally regulated professions, an employer may not simply test, including in offshore or construction, unless there is a specific legal basis.

What does this mean for you?
